These terms and conditions shall apply to your use of the JobMarina.com website and websites operated by JobMarina Pte. Ltd in cooperation with its Recruitment Partners (Website). By accessing the website, you agree to be bound by these terms and conditions. If you do not agree to be bound by these terms and conditions, you shall not use or access the website and we have the right to restrict or prevent your access to our website.

The Website is operated by JobMarina Pte Ltd in cooperation with its Recruitment Partners and is hosted by eDLink Services Pte. Ltd.

We will provide you with access to the Website in accordance with these Conditions.

Definitions

"Conditions" means these terms and conditions:
"User(s)" (a) user(s) of the Website either collectively or individually, as the context requires;
"Personal Information" means any personal details provided by you via the Website;
"We/us/our" means JobMarina Pte Limited;
"Website" means the website located at www.JobMarina.com , Recruitment Partner site URLs or any subsequent URLs which may replace them;
"You/your" means you as a user of the Website.

1. Your Obligations

1.1 You

(a) agree not to use the Website (or any part thereof) for any illegal purpose and agree to use it in accordance with the law;
(b) agree not to upload or transmit through the Website any a) computer viruses, macro viruses, trojan horses, worms or anything else designed to interfere with, interrupt or disrupt the normal operating procedures of a computer b) material which is defamatory, offensive, or of an obscene or menacing character, or that may cause annoyance, inconvenience or needless anxiety, or is copyrighted (unless you are the copyright owner or have permission of the copyright owner to post it), or reveals trade secrets (unless you own them or have permission of the owner) or infringes on any other intellectual property rights of others or on the privacy or publicity rights of others.
(c) will not use the Website a) in a way that may cause the Website to be interrupted, damaged, rendered less efficient or such that the effectiveness or functionality of the Website is in any way impaired, including, without limitation, “overloading”, “flooding”, “spamming”, “mail-bombing” or “crashing”, b) in any manner which violates or infringes the rights of any person, firm or company (including, but not limited to, rights of intellectual property, rights of confidentiality or rights of privacy);
(d) will not i) send unsolicited e-mail, including promotions and/or advertising of products or services. ii) attempt any unauthorised access to any part or component of the Website; and

1.2 Personal Information & Bio-data databases

You agree to be solely responsible for the form, content and accuracy of any personal information including bio-data or CV or material posted by you on the website.
(a) You agree to provide your personal information which is true and correct and it shall not be, misleading, deceptive, inaccurate or likely to mislead or deceive. We reserve the right to remove any information, which we deem to be misleading, deceptive, inaccurate or of an unacceptable standard.

By submitting content to the Website, including a job advertisement, bio-data or any other content, you grant us and our affiliates the royalty free, perpetual, irrevocable, sub-icenseable, non-exclusive, full right to use, reproduce, modify, publish, translate, transmit, communicate, display or create any derivative works from such content.
We reserve the right to make inactive or delete without prior notice any registration or bio-data personal information.

2. Indemnity

You agree to indemnify us against all claims, liability, damages, losses, costs and expenses, including legal fees, suffered by us and arising out of any breach of the Conditions by you or any other liabilities arising out of your use of the Website, or the use by any third party accessing the Website using your internet account.

3. Our rights

3.1 We reserve the right to:
(a) modify or withdraw, temporarily or permanently, the Website (or any part thereof) with or without notice to you and you agree that we shall not be liable to you or any third party for any modification to or withdrawal of the Website; and/or
(b) change these Conditions from time to time at our sole discretion, and your continued use of the Website (or any part thereof) following such change shall be deemed to be your acceptance of such change. It is your responsibility to check regularly to determine whether the Conditions have been changed. If you do not agree to any change to the Conditions then you must immediately stop using the Website.
(c) make inactive or delete at any time and without prior notice any personal & bio-data information from JobMarina. In these instances we shall endeavour but are not obliged, to contact you in advance.
(d) remove notices, résumés, advertisements and other communications which are abusive, illegal or disruptive.

3.2 We will use our reasonable endeavours to maintain the Website. The Website is subject to change from time to time at our sole discretion. No compensation is payable to you if you cannot use any part of the Website or because of a failure, suspension or withdrawal of all or part of the Website without any reasons whatsoever.

3.3 The submission of your bio-data does not require us to provide you with a job opportunity.

4. Third party links

To provide increased value to our Users, we may provide links to other websites or resources. You agree that we are not responsible for the availability of such external sites or resources, and we are not liable, directly or indirectly, for the privacy practices or the content (including defamatory content) of such websites, including (without limitation) any advertising, products or other materials or services on or available from such websites or resources, nor for any damage, loss or offence caused or alleged to be caused by, or in connection with, the use of or reliance on any such content, goods or services available on such external sites or resources.

5. Monitoring

We have the right, but not the obligation, to monitor any activity and content associated with the Website. We may investigate any reported violation of these Conditions or complaints and take any action that we deem appropriate (which may include, but is not limited to, issuing warnings, suspending, terminating or attaching conditions to your access and/or removing any materials on the Website).

6.1 By submitting your bio-data, you have authorized us to make available the information you have provided, only to prospective employers.

6.2 We respect your personal information and we do not disclose information about your individual visits to the Website or personal information that you provide, such as your name, address, email address, telephone number etc. to any outside or third parties, without your permission except when we believe the law requires it. However, in addition to the terms and conditions that may be contained in any privacy policy on the website, you understand and agree that we may disclose to our partners and third parties, on an anonymous basis, certain aggregate information contained in your personal information.

6.3 We reserve the right to offer third party services and products to you based on the preferences that you identify in your registration and at any time thereafter; such offers may be made by the us or, via us, by our Partners or Third Parties. You should be aware that:
(a) if we are requested by the police or any regulatory or government authority investigating suspected illegal activities, or upon receipt of a court order, to provide your Personal Information and/or information concerning your activities whilst using the Website we shall do so; and

8.2 The Website is provided on an “as is” and “as available” basis without any representation or endorsement and we make no warranties of any kind, whether express or implied, in relation to the Website, including but not limited to, implied warranties of satisfactory quality, fitness for a particular purpose, non-infringement, compatibility, security, accuracy, conditions of completeness, or any implied warranty arising from course of dealing or usage or trade.

8.3 Whilst we ensure the quality of the website, we make no warranties as to the truth or accuracy of job advertisements or bio-data posted by recruiters or job seekers, the ability of employers to offer job opportunities to job seekers or the availability of job seekers to fill job opportunities.

8.4 We make no warranty that the Website will meet your requirements or will be uninterrupted, timely, secure or error-free, that defects will be corrected, or that the site or the server that makes it available are free of viruses or bugs or represents the full functionality, accuracy, reliability of the materials. We will not be responsible or liable to you for any loss of content or material uploaded or transmitted through the Website.

8.5 You agree that we cannot guarantee and be responsible for the security or privacy of the Website and any information provided to or taken from the Website by you.

8.6 We will not be liable, in contract, tort (including, without limitation, negligence), pre-contract or in connection with these Conditions for:
(a) any economic losses (including without limitation loss of revenues, profits, contracts, business or anticipated savings); or
(b) any loss of goodwill or reputation; or
(c) any physical, moral or financial harm that you may suffer as a result of dealing with others with whom you come in contact through the website.
(d) any special or indirect or consequential losses; in any case whether or not such losses were within the contemplation of either of us at the date on which the event giving rise to the loss occurred, suffered or incurred by one of us arising out of or in connection with the provisions of any matter under these Conditions.

9. Termination

We reserve the right, at our sole discretion, to pursue all of its legal remedies, including but not limited to deletion of your personal information from the website and immediate termination of your registration with or ability to access the Website and/or any service provided to you by us, upon any breach by you of these Terms & Conditions or we are unable to verify or authenticate any information you submit to the Website.

10. Severance

If any part of the Conditions shall be deemed unlawful, void or for any reason unenforceable, then that provision shall be deemed to be severable from these Conditions and shall not effect the validity and enforceability of any of the remaining provisions of the Conditions.

13. Law

The Conditions shall be exclusively governed by the laws of Singapore and Singapore Courts shall have exclusive jurisdiction in any dispute.
